GoGo Cast, Inc. vs LG Electronics USA, Inc.

Here’s an interesting piece of litigation that our spiders picked up this week; GoGo Cast, Inc. vs LG Electronics USA, Inc., LG Electronics, Inc. and AVNET, Inc. filed in the U.S. District Court District of Rhode Island back in July 13, 2012.

Reading through the documents filed with the court, it seems that GoGo Cast are claiming the Defendants sold them equipment not fit for purposes (media players are mentioned in one specific instance).

During 2010 and 2011 GoGo Cast purchased equipment from the Defendants totalling USD 500,000 and spent USD 110,000 installing same.

GoGo Cast claim that the equipment partially and/or completely failed to operate on a daily basis by overheating in normal operating conditions.

GoGo Cast are claiming, we quote, “sustained damages as a proximate result of the foregoing breach(es) of the Defendants of the Equipment Agreements, including, without limitation, damages in excess of $1,700,000.00 as well as costs, expenses and attorney’s fees”.

We put in a call to David Paolo, President and CEO of GoGo Cast who told us “As you probably would understand, out of respect of protecting the company’s interests, the company can not comment on current matters in litigation or pending litigation”.

The court records however are a matter now of public record.
